Liability Waiver and Release for Principle Baseball

By participating in any activities at Principle Baseball, located at 501 Okerson Road, Howell, NJ 07731, including but not limited to batting cage use, pitching practice, fielding drills, baseball/softball instruction, camps, clinics, rentals, or other events (collectively, “Activities”), you acknowledge and agree to the following terms of this Liability Waiver and Release (“Waiver”). If the participant is under 18 years of age, a parent or legal guardian must read and agree to this Waiver on their behalf.

1. Acknowledgment of Risks

I understand that participation in the Activities at Principle Baseball involves inherent risks, including but not limited to:

• Being struck by a baseball, softball, bat, or other equipment, which may cause serious injury, concussions, or death.
• Physical injuries such as muscle strains, sprains, tears, broken bones, or other bodily harm from physical exertion, tripping, or falling.
• Injuries caused by the actions, inactions, or negligence of other participants, instructors, or staff.
• Injuries resulting from the condition of the facility, equipment, or premises, including pitching machines, netting, or turf.
• Risks from simultaneous sports activities occurring in the facility.

I voluntarily assume all such risks, whether known or unknown, by participating in the Activities.

2. Assumption of Risk

I, the participant (if 18 or older) or the parent/legal guardian of the minor participant, knowingly assume all risks associated with the Activities, including those caused by my own actions, inactions, or negligence, the actions or negligence of others, or the condition of the premises or equipment.

3. Release and Waiver of Liability

In consideration of participating in the Activities at Principle Baseball, I, for myself, my heirs, executors, administrators, and assigns, hereby release, waive, discharge, and agree not to sue Principle Baseball, its owners, officers, directors, employees, coaches, instructors, volunteers, affiliates, and agents (collectively, the “Released Parties”) from any claims, damages, or liabilities arising from personal injury, death, or property damage related to my participation in the Activities, except in cases of gross negligence or intentional misconduct by the Released Parties.

4. Indemnification

I agree to indemnify and hold harmless the Released Parties from any claims, damages, or costs (including reasonable attorney fees) arising from my participation in the Activities or violation of this Waiver or facility rules.

5. Health and Safety

I represent that I (or the minor participant) am in good physical health and have no medical conditions that prevent safe participation in the Activities. I agree to follow all facility rules, including:

• No horseplay, inappropriate behavior, or throwing balls outside designated areas.
• No tampering with or damaging netting, equipment, or facility property.
• Use of required protective gear (e.g., helmets).
• No participation without a signed waiver and payment of applicable fees.
• Compliance with staff instructions.

Failure to comply may result in removal from the facility and/or termination of access privileges.

6. Minors

If signing for a minor, I acknowledge that New Jersey law may limit the enforceability of this Waiver for claims involving minors in commercial recreational settings. I agree to this Waiver to the fullest extent permitted by law.

7. Governing Law

This Waiver is governed by the laws of the State of New Jersey. Any disputes shall be resolved in the courts of Monmouth County, New Jersey.

8. Acknowledgment of Understanding

I have read and understand this Waiver. I acknowledge that by agreeing, I am giving up certain legal rights, including the right to sue the Released Parties for injuries or damages arising from ordinary negligence. I agree voluntarily, without duress, and with full knowledge of the legal consequences.
